Terms of Service

1. Agreement

By accessing or using Delton Audio products, services, and website, you agree to these Terms of Service and related policies.

2. Current Business Status

Delton Audio is currently in pre-launch development. As of the effective date, commercial plugin sales are not yet live and required business registration steps (including KVK registration) are in progress.

3. Eligibility and Accounts

• You must provide accurate account information and keep credentials confidential.
• You are responsible for activity under your account unless caused by our security failure.
• We may suspend or terminate accounts involved in abuse, fraud, or unlawful conduct.

4. Orders, Pricing, and Checkout

• Prices are shown in supported display currencies and may change before purchase.
• Taxes may be applied where required by law.
• Orders are completed only after successful authorization/processing.
• Paid orders begin only after Delton Audio enables commercial sales and required registrations are complete.
• As of the effective date, checkout flow includes account-linked digital fulfillment and free-checkout support for eligible 100% discount orders.
• When paid card processing is enabled, payment data will be processed by the configured payment provider.

5. Digital Delivery and Licensing

Products are digital licenses. Download access is tied to account ownership records and may require authentication checks before installer delivery. Plugin usage is governed by the Plugin EULA.

Unless otherwise stated for a specific product, each license may be active on up to 3 devices at a time. Activating on a new device after the limit may automatically remove the oldest existing activation.

6. Refunds

Refund requests are handled under our Refund Policy. If a refund is approved, related license/download entitlements may be revoked.

7. Acceptable Use

• Do not reverse engineer, crack, redistribute, or bypass licensing controls.
• Do not interfere with site security, availability, or service integrity.
• Do not infringe intellectual property rights or violate applicable law.

8. Intellectual Property

Delton Audio software, branding, and website content are owned by Delton Audio or its licensors and protected by applicable intellectual property laws.

9. Disclaimers

Services are provided "as is" and "as available" except where limits are not permitted by law. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by law, Delton Audio is not liable for indirect, incidental, consequential, special, or punitive damages. Total liability is limited to the amount paid by you for the relevant product in the 12 months before the claim.

11. Termination

We may suspend or terminate access for material violations of these Terms. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules. Disputes shall be submitted to the competent court in Utrecht, the Netherlands, without prejudice to mandatory consumer rights under applicable law.

13. Changes

We may update these Terms from time to time. Revisions are effective when posted with a new effective date.
